Without fear or favour - Part 2

A couple of days ago, I was in a situation where most trial lawyers would get themselves into.

I was acting for the Plaintiff (the party who sues others is called a Plaintiff). My matter was fixed for hearing on Monday morning at 9.00 am at Shah Alam Sessions Court.

On Friday evening, the Defendant solicitor called and told me that he had to conduct trial at Kuala Lumpur Sessions Court so he would be late on Monday. He requested me to stand the matter down to 11.00am so he could rush from Kuala Lumpur. He asked me whether I was agreeable to postpone the matter on Monday and take another hearing date, I told him I was not agreeable as the matter has been delayed for 2 years. I agreed to stand the matter down to 11.00 am and asked him to send me a letter confirming the telephone conversation.

I did not receive his letter on that Friday.

On Monday, our hearing date, I was in Shah Alam Sessions Court as usual. When my matter was called up by the court at 9.30am, I informed the Judge that my opponent was not in court and requested the matter to be stood down. The Judge allowed my request and listened to other files first.

I was patiently sitting in the court waiting for the arrival of my opponent.

When my matter was called up again by the Court for the second time, it was already 11.30am. I have waited in the court for 2 hours for my opponent to show up!

The Judge asked me, “ok, apa kes awak? Mana defendan? (What is your case? Where is the defendant?)”

That was the time I had to make the crucial decision. I had 2 choices i.e. either informing the Judge that my opponent was not in the court and I wish to wait for him and requesting to stand the matter down again OR informing the court that I do not wish to wait for my opponent anymore and requesting for the case to be heard in his absence.

Fear rushed through my veins and my judgment was clouded by doubts.

Why?

I had promised to wait for my opponent till 11.00 am hadn’t I? If he was just merely 30 minutes late, can’t I just wait for him for a little longer? He might be stuck in a traffic jam!

But on the other hand, he was late, wasn’t he? I owed a duty of care to my client not to my opponent, agree? In the circumstances, what was the best for my client? Of course my client would be delighted if he knew that the matter was not postponed further and judgment was entered against the Defendant.

If I give chance to my learned opponent, I would win friendship but this matter might be postponed to another date and my client would suffer further delay.

If I decide otherwise, my learned opponent would curse me acrimoniously and label me as a man without honour but my client need not endure another round of delays.

I was only given a few seconds to make the decision.

Without fear or favour - Part 1

"...Upholding the cause of justice without regard to its own interest and without fear or favour."

That’s the heading you will see when you visit Malaysian Bar website.

The phrase “without fear or favour” has been repeated thousands times since the day I read law. However, just like I never paid much attention to my high school motto (Manners, Justice, Integrity and Honour); I just took this phrase for granted. Never had I given much thought about it.
How do you act for someone without fear?
The conquering of my own fear had been the integral part of my job scope. Though I am not so ambitious to be a fearless lawyer, it still requires a great deal of strength to overcome my fear.

Dealing with hostility is so akin to a lawyer’s job that it goes without saying. Almost everyday I have to meet angry and dissatisfied man and women. It’s only natural. Who will be happy when they receive a lawyer’s letter demanding for money, land, etc? Who will be delighted when they receive a lawyer’s phone call asking for fees? You get my point. That’s why lawyers had become a pain in the a** and so many jokes specially dedicated to lawyers.

“Why a lawyer’s heart is the cleanest?”
“because it has never been used.”

“You were in a jungle with a gun and two bullets. You met with a venomous king cobra, a hungry and ferocious tiger and a lawyer. What should you do?”
“Shoot the lawyer twice.”

Lawyer talking to his client, “Mr. Chua, you must understand, Justice must not only be seen to be done, it must also be paid to be done…”

This article is not intended to defend the integrity and pride of this profession because I know it would have been a futile exercise. Instead the purpose of this article is to share with the readers, what went through a mind of a young lawyer, when confronting his own fear.

Our Club is the Best New Rotaract Club


Great news again! Last Saturday night (17-6-2006) a total of 9 of us attended the District Award Night held at Holiday Villa, Kuala Lumpur. I will not go into the details of the Award Night as Rtr Zeekin has graciously agreed to write about it and publish in this blog later.

It is my great honour to announce in this blog that our club was awarded the "Best New Rotaract Club" for year 2005/2006! Well done everyone!

Not to mention that our club's 100 percenter rotaractor guest (it's official confirmed) President Harley received the recognition of being "the Rotaractor of the Year". Congratulation President Harley! Well done! Our club is so proud of you!

A day in the life of District Secretary for Attendance

Act 1

Scene 1

District Governor (DG) gets ready to get into his chauffer driven Kembara on his official Club visit to the clubs in the north. Once settled down comfortably in his plush half leather seat he opens up the latest issue of the Monthly Governors Newsletter and to his horror sees that not all clubs in his district submits their attendance report. DG picks up his latest Maki-a mobile and calls the District Secretary for Attendance (DSA).

DG: District Secretary for Attendance (DSA), how is the attendance report coming from the clubs?

DSA: Er…DG generally all clubs are ok… it is the 15th of the month but there is still some clubs who has yet to submit their reports.

DG: Tell me who they are and I will call the President personally

DSA: Clubs A, B & C have yet to submit.

DG: OK thanks……. (and hang up his mobile)


Act 2

Scene 1

DG calls up the President of Club A from his mobile along the NS Highway.

DG: Hello, President A (PA) this is District Governor DG. How are you? And how is you club coming along?

PA: Good Morning DG, fine…fine…how are you? The phone reception is not so good

DG: Ya…ya….I am on the NS Highway to visit Club Z. Have your club submitted the attendance report to DSA?
PA: Of Course. We submit promptly every month. The Club has a very efficient secretary.

DG OK ,…good. But I heard from DSA that for this month your club has not submitted its report.

PA: Is that so? Impossible!! Let me check and get back to you?


Scene 2

President A calls Club Secretary A and ask whether the report has been submitted to the DSA. Club Secretary says that he has, as usual submitted promptly by the 10th of the month

Right after Club Secretary A puts down his fixed line phone, his mobile rings and the DSA is on the line.

DSA: Hello PP Club Secretary A (a past president), this is DSA. Have you submitted your attendance report for last month?

CSA: Er… no, not yet. You know lah very busy what with work and sending children all over. This is a voluntary matter. Got time submit lah, no time later lah. Sometimes I give you 3 month attendance (in one go) what. OK want lah don’t worry


Act 3

Scene 1

DG calls up the President of Club B from his mobile. Now he stops at the rest area for toilet call.

DG: Hello, President B (PB) this is District Governor DG. How are you? And how is you club coming along?

PB: Good Morning DG, fine…fine…how are you?

DG: OK on my way to visit Club Z. Have your club submitted the attendance report to DSA?

PB: I am not sure. I need to check with the secretary, anything else?

DG: I heard from DSA that your club has not submitted its report for last month’s attendance.

PB: Let me check and get back to you?


Scene 2

President B calls Club Secretary B and ask whether the report has been submitted to the DSA. Club Secretary B says that he has. Right after club secretary puts down his fixed line phone his mobile rings and the DSA is on the line.

DSA: Hello Club Secretary B, this is DSA. Have you send a copy of your attendance report for last month? I don’t remember receiving it.

CSB: I have already email to you what. Never receive ah. Ok Ok I will email again later You know lah all this email sometimes my mail also go missing very teruk lah.


Scene 3

DSA finally receive the report from Club Secretary B 5 days later…by fax.


Act 4

Scene 1

DG calls up the President of Club C (PC) from his mobile. He is on the road again

DG: Hello, President C this is District Governor DG. How are you? And how is your club coming along?

PC: Good Morning DG, fine…fine…how are you?

DG: Have your club submitted the attendance report to DSA?

PC: I am not sure. I need to check with the secretary, anything else?

DG: I heard from DSA that for this month your club has not submitted its report.

PC: Let me check and get back to you?


Scene 2

President C calls Club Secretary C and ask whether the report has been submitted to the DSA. Club Secretary says that he has. Right after club secretary puts down his phone his mobile rings and the DSA is on the line.

DSA: Hello Secretary C, this is DSA. Can you send a copy of your attendance report for last month? I don’t remember receiving it.

CSC: I don’t know I missed the last few meeting. Didn’t the President C send it to you? Let me check and get back to you.

DSA is still waiting, not knowing whether President C or Secretary C will send the report.

P/S: For the info of Rotaractors, the DG has to submit the attendance report to RI (for compilation and statistical purposes on the performance of the district). The characters potrayed is fictional and any reference to any particular individual (dead or alive) is purely unintentional.

Getting the First Pay Cheque

It started with nothing in the bank account
Until I banked in my First Pay Cheque
So delighted was I looking at the numbers
I even photocopied the cheque and kept it in my drawer

The numbers were not much
Can’t even sponsor my trip to Pulau Tenggol
Yet the satisfaction was indescribable
For I then thought I am rich and capable

I passed by a fantastic Japanese restaurant
5 plates of expensive sushi went into my mouth
I heard the cricking noise of my car
There goes RM700.00 from the account

Soon the numbers in the account accumulate
From 4 digits to 5 digits
But I have stopped looking at the numbers
For I started looking at the numbers of others

My friend of same profession works in KL
He just changed his car recently
Though I am not a big fan of cars
I still think I deserve more than a Proton Wira

Months after months, years after years
The pay cheques get bigger and bigger
But the thrills of getting the pay cheques diminished
As by the end of the month, it will be finished

Now I am looking at the numbers again
Mathematically it is significantly larger than the First Pay Cheque
Nevertheless it seems so insignificant, so strange
Was it the number or me who had changed?

Interview Skills for Managers

I don’t know how to blog. I am always thinking, why in the world would anyone want to read what I have written and why would I want people to read what I have got to say? Guess I am not really in-tune with the youthful broadband trend. I am still very biased towards online ‘friends’. For those that are wondering, I am 25 years of age, not 52!

Thus, when I was told that I am nominated to attend this course (which I am about to tell you), the first thing that came to my mind was, “Good! Now I can be one of the blog’s CONTRIBUTORS ” (and the article is in-line with our P.E.’s theme for the year!). So, NONCONTRIBUTORS, do something!

Interview Skills for Managers. That’s the course I just attended. This is a course for the benefit of interviewers, not interviewees but I am sure everyone can pick up a pointer or two. You can even use it on your boyfriends so that you can prevent/detect them from lying. This is not applicable for girlfriends coz everyone knows only men lie : )

All right, let’s start with the academics!

Basically there is only ONE thing to remember when interviewing (or in other cases, interrogating) a candidate (loved ones). It is the QUESTIONS you ask. There are 3 types of questions; leading questions, theoretical questions and behavioral questions. For clarification, read on!


Leading questions
Questions that prompt the candidates (loved ones) to give you pleasing answers, answers that you want to hear.

Example 1:
“You are here for the sales position. So, you do you like sales?”
Please, who in the world will answer “No” to that? Maybe our Ah Loot?

Example 2:
"Dear, this dress is so beautiful. I look absolutely gorgeous, right?”
Even Ah Loot won’t say “No”.


Theoretical Questions
These questions encourage candidates (loved ones) to talk about their views, theories but not what they have been through.

Example 1:
Question to a Junior Executive: “If you were to lead a project, how would go about it?
Bonus question for bullshitters. They can babble on and on and yet you can’t obtain anything significant from the answers because the situation never happened. He/She can say whatever she likes. Don’t forget, “empty vessels make the most noise”.

Example 2:
“Sweetie, what would you do if the hottest chick at your workplace throws herself on you?”
Your man may give the most politically correct answer but yet you can’t judge him from his answer because it has never happened (and most probably never will.. got it? : ))


Behavioral Questions

Questions that enable candidates (loved ones) to provide you with specific details to something that has happened. This also enables you to probe and find out if the person is lying!

Example 1:
“You mentioned in your resume that you handle customer complaints. Tell me about the most difficult customer you handled and how you rectified the situation.”
This question enables you to identify the person’s character and how he/she handles the situation. This also gives good predictability on how he/she might perform in future.

Example 2:
“Baby, you said your ex-girlfriend cheated on you. So what did you do about it?”
If he says, “I broke her neck”, my advice is, you should seriously reconsider if you intend to cheat on him : )

Doubting myself

I was sleepy. My watch showed that it was 11.15pm. It was time to drive to the cinema to watch midnight show with my fellow rotaractors. I was excited to see a number of 18 friends watching movie together. The show was ok but the novel is definitely better. After the show, I drove back home with dreamy eyes.

This experience cost me RM10.00.

I dressed smartly. I drove all the way from Klang to Kuala Lumpur with a group of friends at peak hour to attend the District Joint Conference. I slept and dined in 5 stars hotel for 3 days 2 nights. Luckily I met a few Hong Kong Rotaractors and had great time with them.

This experience cost me around RM200.00.

I joined the delegates to visit Taiwan. I enjoyed every moment once I stepped out from the airplane. I explored Taiwan and discovered interesting facts about her. I had funs with the Taiwanese who were so warm and friendly. Before I came back to Malaysia, we promised to visit each other. My horizon has widened.

This experience cost me around RM1,800.00.

I carried the heavy oxygen tank, put on my mask and fins, jumped into the crystal clear sea. I breathed under water, sucking the cold air flowed from the tank on my back. I swam like a fish. Except the voice of my own breathing, I could hear nothing else.

This experience cost me around RM2,000.00.

I will stop here.

Whenever I see an opportunity to take a sudden turn i.e. doing something different, my nerves will get excited. Inside me, there will be 2 figures arguing with each other: I call them Mr. Fear and Mr. Freedom.

Mr. Fear will always say, “Hey! You are not earning a lot! Work harder! Maybe even quit your job now and look for job that pays you more. Save the money. Play it safe. Do it the conventional way. Think twice before you decide on anything. Go home early everyday. Stay at home because going out means spending money.”

Mr. Freedom will reply, “yeah right, you only live once. You are in your 20s for one time only. Your health is your wealth and you cannot stay healthy forever. So don’t waste time doing nothing at home while you are young! Engage in something exciting! Expose yourself to more activities! Come out from the comfort zone and meet new faces everyday!”

I do have doubts most of the time. Mr. Fear will win a few arguments sometime, that’s when I say no to an offer and crawl back to my comfort zone.

I realize that life is fair. You give some you take some. Nothing is free. Everything comes with a price tag. The question of “whether it’s worthwhile to do it” will ultimately depend on my own value, my judgment.

Am I doing the right thing? Or am I wasting my time?

After setting everything right...

A Rotaract year has left you high and dry at lightning pace. It has certainly made a crashing impact on all individuals involved. Time was filled with happiness, joy, fun, laughter, excitement and rewards. To be able to experience so much fun with once strangers in our lives was something unthinkable. To be able to make so many friends within a year was hardly possible. At times, we were hit with stress and challenges.

Unknowingly, these things have made those souls who took up the hardship so called “invincible”. President Toh has indeed set everything right, taking the initiative to lead the once vulnerable club to now a high flying one. Those who had experienced it need no further explanation; those who had not, you already know where to find us by reading this article. He might look like malnutrition lawyer wearing flowery red pajamas pants, but only a few can out-talk him when he makes a stand. The one thing that one may successfully overpower him is DOTA, so President Toh, Gambateh!

With a club well equipped with fighters capable of taking the whole Klang town (Currently, only that capacity due to inadequate manpower… aiming for the whole world), President Toh will be passing me the baton by the end of the month. Being supersede to “Set Everything Right”, the incoming theme will be adopting a journey back to school days.

Don’t get me wrong, that doesn’t mean that our meetings will be classroom style; president will be holding a cane or even cute girls wearing skirts (maybe a little resemblance of individuals getting fined for being late). The coming theme will be filled with the essentials of life, learning. Learning will be cultivated into all activities organized by the club, regardless avenue. Project managers not only organize a particular activity for the fun of it, but will also look into educating the participants with knowledge and purpose of executing that project. One has to realize the significance of the project for it to be meaningful.

A person can always group a number of people and organize a visit to the orphanage, but if the group has prior briefing on the background of the orphanages, i.e. abused children, they will be more affectionate dealing with those children. Likewise, if the club organizes a paintball event and not brief about the essentials of teamwork, the teams might end up playing inefficiently without an aim. We should strive to teach target participants as fun and as effective possible to create awareness.

Things that you don’t learn in school – Emotional Intelligence

Last weekend, our club members had a fellowship activity in Rotaractor Lloyd’s to play a game called Cash flow quadrant invented by Hawaiian born Robert Kiyosaki, author of the ‘Rich Dad, Poor Dad’ bestsellers series. After spending three solid hours in the game, I realized that I have been spending money in the unnecessary places and investing it in the wrong channels.

I did not know the concept of passive income until friends (especially Rotarian Patrick) shared with me this concept. I am an accountant by profession. I should possess skills like effective money management. But still, and heck, what do I know about managing my money?

Before the book ‘Rich Dad Poor Dad’ became a best seller (and propelled Robert K to fame), I was introduced to a book titled also by Robert Kiyosaki ‘If you want to be rich and happy, don’t go to school’. Now it makes sense. The author was trying to deliver the message to Americans telling them don’t get caught chasing the American dream (go to an Ivy League school, graduate and get a well paid job with long working hours hoping to climb corporate ladder and earn lots of money to purchase big houses, big cars) or they will end up getting broke and in debt by age of 60.

School here refers to a formal education up to Form Five, Form Six and then basic/honors and masters degree in university. All of us spent our childhood and teenage stages studying essential skills to live and survive. Actually, are we applying what we learn in school when we start our adulthood? I remembered I spent my school days cramming up facts and figures on accounting standards for the dreaded exams that never seem to end. And this game got me thinking; I never actually learn essential skills in school like personal financial planning and other skills as well such as:

Soft skills which is communication skills. Example: Speaking out for the right reasons (please refer to Rotaractor Tracy’s article – Speak Out).
Emotional intelligence.
How to be a better husband or wife

The list goes on. In this article, I will touch about emotional intelligence as this had proven useful to me in my everyday life.

What is emotional intelligence (EI)? I had extracted from my company’s e-learning system Edvisor which I am taking an exam to pass it (It is rather lengthy, please take time to digest)

Emotional intelligence sometimes refers to as social intelligence refers to ability to recognize and analyse your own emotions and the emotions of those around you. You observe your own emotions and find strategies of handling and channeling in a service of a goal.

You also take perspective of others for being sensitive to their feelings and concerns and appreciating the differences on how people feel about things.

Emotional intelligence (EI) encompasses the following characteristics and abilities.

Knowing your emotions
Managing your emotions
Motivating yourself
Recognizing and understanding other people’s emotions
Managing relationships by managing emotions of others.

Emotional intelligence is intended to help to improve your relationships and your own self awareness. Emotional intelligence can be increased by being more conscious of your choices.

How EI can be useful? Below are the typical day scenarios we had to face sometimes:

Scenario 1

You came in to office feeling happy and cheerful after an enjoyable weekend. You sat with your colleague in the next door cubicle and realized she is in a foul mood and does not want to talk to you.

What would you do? Will you back off and leave her alone, thinking she may need time alone? Or will you feel angry and think ‘What I have done wrong? Why she is cold towards me?’

Scenario 2

Husband walks into a room and finds his wife quiet and frowning. He asked ‘What’s wrong, honey?” She answers “Nothing. Why are you so concern?” Will you as a man feel worried, angry, hurt or thinking ‘Oh my God she is having a (Premenstrual Syndrome) PMS mood again’.

If a person is lack of emotional intelligence, he or she will easily get hurt, easily be affected by the bad mood or vibes, emotional, always angry, has high unreasonable expectations on how others should behave and ended hating others for not emotionally fulfilling their needs.

There is saying says that being happy is contagious. It spreads around fast. Bad mood is contagious too. It can affect us any time. The key point of being emotionally intelligent is to assess and recognize that anyone can have bad moods once in a while. Even my dog has bad mood days too. The key point is not to take it personally and communicate effectively to the person concerned. (And try not to scream and shout)

To communicate effectively, I will always assess the mood of the person so that I can filter my thoughts and compose my words before speaking. And, knowing this will help you to approach a person at a right time and right place (especially your boss).

What makes a person respected and well liked? It is not having lots of money or high IQ (strings of university degrees) but someone who has abundance of emotional intelligence.

There is a classic joke in my toastmaster club that I would like to share. In a toastmaster club, you have the opportunity to obtain speech awards after completing some speech assignments from basic level to the highest (distinguished) level.

First level: Competent Toastmaster award (CTM) – need to complete 10 speeches-beginners level

Joke: If you achieved a CTM, meaning = Cannot Talk Much
(The first few speech assignments can be nerve wrecking for new members or beginners, always a struggle for them before reaching the advanced level)

Advanced Level: Advance Toastmasters-Bronze, Silver and Gold (ATM).

Joke: If you complete an ATM, meaning you are labeled ‘Always Talk Much’ (it makes sense, as members have to talk more to achieve the three advanced level awards)

The highest recognition level a member can achieved from Toastmasters International is:

Distinguished Toastmaster (DTM), meaning = Don’t Talk Much
(That is where you have to shut your mouth and speak out only for the right reasons.)

Being emotionally intelligent and able to communicate effectively goes hand in hand.
I had learned that tremendously from the working world. To me it is a survival skill besides swimming and cooking.

What the world would be today if we are not emotionally intelligent?
Interesting fact: The first time a woman from Iran competed in the Olympics was in 1996.

Dear President Low,

Thank you very much for extending the kind invitation to Brenda and me to attend your 19th Anniversary dinner held on 21st May 2006. I am indeed very delighted to note that your club is very active, with good fellowship and the enthusiasms to serve and carry out the work of Rotary.

I am very touched and happy to say that the Rotaractors from your Club are very much involved with your Club activities, which is a very healthy sign of the partner in service or Family of Rotary. Please convey my regards and commendation to your IPP Michael Tan for the job well done as the Advisor to the Rotaractors, he has demonstrated his dedication and leadership in taking care of the Rotaractors.

As you are aware that from next Rotary year RI President Bill Boyd is very keen to see that the Family of Rotary is being carried out. "Extract of the Interview of Incoming RI.President Bill Boyd" You also feel strongly about the family of Rotary. What do you hope Rotarians will achieve in this area during your year? When Past President Jonathan Majiyagbe first began talking about the family of Rotary, there were many Rotarians who were not sure of what he meant. I think that now we understand that our Rotary family includes Rotaract, Interact, Inner Wheel, Rotary Community Corps, Probus, the alumni and alumnae of our Rotary Foundation, the staff of Rotary International, our own families, the widows and widowers of Rotarians, even those who actively partner with us in service activities. All of us who are working in the achievement of Rotary goals are members of the family of Rotary, and next year we will have a resource group to help us ensure that we do not leave anyone out.

The emphasis on caring equally for everyone in the Rotary Family .Youth programme such as Youth Exchange, Interact and Rotaract are vital to ensuring the health of Rotary's future. They also further Rotary's work by instilling the integrity tolerance and unselfishness in the next generation.

I am requesting that Rotarians at the club and district level help support Rotaract! If every Rotarian made a point of doing this, we would surely reach our goal this year of starting a new Rotaract club in every district. Club presidents can make a big difference in leading the way. Rotary will be a stronger and better organization if we can build a better bond between Rotary and Rotaract.

Incoming RI.President Bill Boyd believes that Rotaract will fuel the next membership wave of Rotary helping to move young members ever closer to Rotary's ideal of Service Above Self. "Rotaractors are our best and brightest," "They are our future leaders of Rotary and the world!" Furthermore we are going to have a good DRR in Chandra and we look forward to working with DRR

Thank you President Low I must say that your Club has shown the district that you are Leading the Way for the new Rotarians through your Rotaractors.
